General Business Meeting March 5, 2013 Page 8

Thomas McPhail, DVM: Case number 2011-040325

CHARGES AGAINST MCPHAIL:

Administrative complaint alleges "the respondent failed to practice veterinary medicine with that level of care, skill and treatment which is recognized by a reasonably prudent veterinarian and failed to keep contemporaneously written medical records."

DECISION: GUILTY AS CHARGED

PUNISHMENT:

MacPhail and his wife are unethical. It finally caught up with him. And be careful about his wife; she's just as bad. MacPhail called the owner of a dog being boarded at the hospital. The dog was owned by State Attorney Jill Fitzgerald. She went on vacation, left the dog to be boarded. The dog became ill and was not properly treated. MacPhail called to tell Fitzgerald the dog died. He then went and changed information in his computer to make it appear he and his wife were properly treating the dog.

BEWARE OF THE DOCTORS AT DELAND ANIMAL HOSPITAL.

Monetary Loss: $1000.

My standard poodle was diagnosed by DeLand Animal Hospital as in need of emergency surgery, and they admitted him after 3PM on Saturday 03-31-18.At 9PM, they asked me to take him somewhere else because they did not have a surgeon.I ended up taking Rembrandt to Affiliated Veterinary Emergency Center, but it was too late, and they euthanized Rembrandt at 10:30PM.One of the owners, Tom MacPhail, returned the $1800 that I had paid for the surgery. They could return my payment, but there is no way they could give back the time they wasted delaying Rembrandt’s emergency surgery. This was supposed to be the best 24/7 animal hospital in West Volusia, but for our Rembrandt, it turned out to be the worst place I could have taken him.My heart breaks when I think about the hours he needlessly suffered.

Thank you for the information. Suggest you also review Volusia County FL case #: 2013 12803 CIDL.

Documents speak for themselves against MacPhail, Ulbrich, and DAH.

THE VETERINARY BOARD UNANIMOUSLY DECIDED TO DROP THOSE CHARGES. I can't stand it when people lie.

DeLand Animal Hospital is the best place and these are good people.

Dr MacPhail was NOT charged in regards to the following - "the respondent failed to practice veterinary medicine with that level of care, skill and treatment which is recognized by a reasonably prudent veterinarian and failed to keep contemporaneously written medical records."

THIS IS A LIE and reviewing the veterinary boards proceedings will prove that.
